On the other hand, senior advocate Mahesh Jethmalani, appearing for the RSS, said that Article 19 The right to assemble peacefully without arms under (1)(b) cannot be curtailed without very strong grounds. He questioned the government’s ban on RSS taking out marches in some areas on the ground that PFI was also banned recently. Mahesh Jethmalani said that not a single incident of violence was reported from the areas where these marches were taken out. He had said that RSS volunteers were attacked where they were sitting peacefully. The fact that a banned, terrorist group continued to attack members of the organization and no punitive action was taken is a matter of serious concern. This is a shame, especially when the state government should crack down on the PFI and its affiliates more strictly, but either they can’t control it or they don’t want to because their sympathies are with the PFI.
