Supreme Court – Photo: Amar Ujala, Indore Expansion The Supreme Court has canceled the death sentence of the accused of murdering a girl child after rape. The Supreme Court has said that the accused murdered the girl after raping her but she was a minor then. Under the Juvenile Justice Act, he can be given a maximum sentence of three years. He is in jail for the last five years. So now he should be released. Along with this, the Supreme Court ordered his release. Five years ago this incident took place in Manawar of Dhar district. Functioning of Police Questioned
The Supreme Court has also raised questions on the functioning of the police in this matter. In the verdict given on Saturday 20 page, the court has said that the police did not check the age of the accused. Presented him like a common accused without verifying the same. The apex court bench comprising Justice BR Gavai, Justice Vikram Nath and Justice Sanjay Karol upheld the conviction of the appellant. However, the sentence is quashed. The Court has said that there is no need to send him to the Juvenile Justice Board or any other Children’s Institution as at present his age is shall be more than yrs. He should be released immediately.
Police registered the case by telling the age
This incident 20 December 414. 17 May 2018 the Sessions Court had sentenced the accused to death in this case. The police had registered a case against the accused stating his age as years. The High Court also upheld this decision. The accused raised the question regarding age and challenged the decision of the District and High Court in the Supreme Court through Advocate Amit Dubey. , Supreme Court ascertained the correct age
2023 Police arrested the accused at the time of the incident. The age was told as years. The police did not even present him in the court after seizing his school documents. On this, the Supreme Court asked the Manavar Additional Sessions Court to ascertain the exact age of the accused. The correct age of the accused at the time of the incident was 20 years and 5 months. Advocate Amit Dubey said that after ascertaining his exact age at the time of the incident, the Supreme Court has ordered his release. ,
