During this, the victim told the police that her step-brother forcibly made physical relations with her for several consecutive days. He always threatened to kill her if she told anyone. In this way he continued to misbehave. Section in the case on the basis of the statement of the victim 317, 414(2)n IPC and 5/6 POCSO Act was increased. During investigation, the medical examination of the prosecutrix was conducted. It was found that she had recently given birth to an underdeveloped baby boy. Then blood was taken from the body of the prosecutrix and her new born child for DNA test. Also the blood of his half-brother was taken, which was sent to a specialist for DNA test. The DNA test was found positive. Then after thorough investigation of the case, the challan was presented in the District Court for trial. , During the trial, statements and positive DNA test reports of important witnesses of the case were presented on behalf of the prosecution before the court. Arguments were presented as well. After trial, the Court found the accused step-brother guilty of raping his sister and repeatedly raping her by threatening to kill her. Then the court convicted him under section 414, 376(2)N IPC and 5/6 Poxo Act has been punished with rigorous imprisonment for twenty years and a fine of Rs.4000. ,
