A single bench of Justice DK Paliwal has issued notice to Umaria Police Station and Collector Sanjeev Srivastava in the matter and directed them to submit their reply within four weeks. Tell that this case has been filed on behalf of Savitri Dhurve. In which it has been said that the applicant was the candidate of the District Panchayat President and 233 July 2022 he and his opponent got 5-5 votes in the election of the Speaker. So a lottery was held for the result. It is alleged that the collector changed the slip showing favoritism under the pressure of the leader of the ruling party. On which the petitioner immediately submitted a written complaint and the petitioner was treated indecently by the Collector. Whose complaint was made to the police. A written complaint was made to SP Umaria for not taking any action by the police. After getting the above information, on the second day of the incident, the collector personally went to the police station Umaria and registered an FIR against the applicant. Got it done To cancel which the High Court has been taken refuge. On behalf of the petitioner, it was said that the collector has lodged a false report against the applicant by misusing his position to avoid the action being taken against him. Because it is not necessary for the District Election Officer to personally go to the police station to file a report in case of election. The court was told that the District Election Officer can register an FIR by authorizing any of his subordinate employees or on the spot He can register an FIR by giving instructions to the present SP and station in-charge, but the collector personally going to the police station a day later proves that the collector has filed a malicious report. That too after registering the report of the applicant which comes under the category of counter case. Agreeing with the arguments given by the petitioner, the court issued notice to the collector and directed him to submit his reply within four weeks. Advocate Dinesh Upadhyay appeared on behalf of the petitioner. ,
