Dismissing the petition, High Court Justice Vivek Aggarwal has said in his order that after accepting the compassionate appointment, the claim for higher post does not arise. In the petition filed on behalf of the petitioner KK Pandey, it was said that his father was working as an assistant teacher in Sidhi district. Was posted on the post. His father died on June 2009 while in service. After which he had applied for providing compassionate appointment to the post of peon in the district development block. He was given a compassionate appointment as a peon. It was said in the petition that his educational qualification is Higher Secondary. Therefore, he should be given compassionate appointment in class 3. Dismissing the petition, the single bench has said in its order that after accepting the compassionate appointment, the claim of the applicant for the higher post is not made out. ,
