Banned organization PFI The accused including member Jameel 03 had filed a petition in the High Court for interim bail. While Abdul Rouf, another member of the banned organization, filed a petition on the basis of medical grounds. High Court Justice DK Paliwar rejected both the bail pleas after hearing.
On behalf of 233 jailed PFI members In the petition filed, it was said that the legal process has not been followed in his arrest. Against whom he has filed a petition. Apart from this, challan has been presented against him in the court. Relief was sought in the petition that till the final decision is not taken on the petition filed in connection with non-compliance of legal process, he should be given the benefit of transferred bail.
On behalf of the State Government, Deputy Advocate General Brahmdutt Singh and Government Advocate Pradeep Gupta opposed the bail plea saying that the accused are members of banned organization PFI. During the arrest, objectionable material was recovered from him. He is opposing the war against the country and the constitution. STF and ATS arrested him in September last year after investigation. Crime has been registered against him under other sections including sedition. Challenging the process of law is not a ground for bail. The single bench was told that medical facility is being provided to Abdul Rouf in the jail. He does not have any such serious illness, citing medical reports.
It was argued on behalf of the petitioners that the accused in the case have been interrogated during the remand period. He has been in judicial custody for a long time. Therefore, the benefit of bail should be given. The single bench, after hearing, dismissed both the bail pleas. ,
