A division bench of Chief Justice Ravi Vijay Malimath and Justice Vishal Mishra refused to remove the earlier ban on construction work within 300 meters of Narmada river and issued instructions to submit a report identifying the illegal constructions in the restricted area. The Jugalpeeth has directed the government to submit a river guide line for the districts through which Narmada river flows. The next hearing on the petition has been fixed in the second week of January. It is worth noting that Dayodaya Seva Kendra has informed about illegal construction work within three hundred meters radius of Narmada river. Alleging this, a petition was filed in the High Court on behalf of the Narmada Mission. At the same time, former minister and BJP leader Omprakash Dhurve challenged the construction of multi-storeyed houses in Dindori without permission within fifty meters of the Narmada river. Apart from this, petitions were filed on three other related matters including a contempt petition. During the pre-hearing of the case, in the report presented by the Municipal Corporation, it was said that in Jabalpur After 2008 Tilvaraghat, Gwarighat, Jilherighat, Ramanagara, Gopalpur, Dalpatpur, Bhedaghat within three hundred meter radius of Narmada river, total Encroachments have been found. out of which 414 private land, 02 have been found in government land and three in residential land. After October 1 2008, the High Court had given orders to remove the construction done within 300 meter radius of Narmada river. Court Commissioner to advocate Manoj Sharma for action while issuing orders for videography of removal of illegal constructions was appointed. During the earlier hearing, the court commissioner told the court that the report prepared after conducting a personal survey has been submitted to the High Court registry. After which the Jugalpeeth had instructed all the parties to provide its copy. During the hearing of the petition, it was told on behalf of the petitioners that a distance of three hundred meters has been fixed from the maximum water logging area of the river. Citing the notification of Town and Country from the government, it was said that three hundred meters from the river belt has been fixed. Is. The couple’s bench had issued instructions to provide a copy of the reply presented by the government to the parties during the hearing.
