Expansion Madhya Pradesh High Court in Jabalpur has given relief to police officer Arun Kumar Mishra in the case of Rs 7.5 crore. Police officer Mishra is accused of allegedly taking Rs 7.5 crore on the basis of his name in the diary found during the Income Tax raid. A single bench of High Court Justice Sanjay Dwivedi, while hearing the petition, dismissed the pending departmental inquiry against him.
In the documents found in the raid, the amount and name were mentioned
2011 Four years ago the Central Income Tax Department raided the Bhopal residence of Prateek Joshi, a close aide of Praveen Kakkar, OSD of former Chief Minister Kamal Nath. A huge amount of cash was recovered during the raid. Apart from this, the amount and the name of the person concerned were mentioned in the seized papers. The name of police officer Arun Mishra was written in front of the paper with and three were written in the circle. Its intention was believed to be to withdraw seven and a half crore rupees in three bags. After that a departmental inquiry was initiated against police officer Arun Mishra. Challenging the same, the said petition was filed.
‘Orders for investigation have been issued maliciously against the petitioner’
2011 While conducting the preliminary hearing of the petition, the single bench 750 on March 2011 Departmental inquiry was stayed. During the hearing of the petition, the single bench was told that there has to be a DPC for promotion. Pending departmental inquiry, the petitioner will be deprived of promotion. The Court was told that the Income Tax Department had questioned the petitioner. After enquiry, the Income Tax Department did not take any action against him. Only out of malice, orders for departmental inquiry have been issued against the petitioner.
The single bench has said in its order that A Mishra is written in the paper seized by the Income Tax Department. Its meaning was taken out by Arun Mishra. While the name of the petitioner is Arun Kumar Mishra. The single bench dismissed the pending departmental inquiry. ,
