Public interest in MP High Court A petition has been filed challenging the order to fix electricity rates every month. A division bench of Chief Justice Ravi Vijay Malimath and Justice Vishal Mishra has issued a notice to the MP Electricity Regulatory Commission and the state government in the matter and sought their response.
This PIL has been filed on behalf of Dr. PG Najpande and Rajat Bhargava, President of Citizen Consumer Guidance Forum. It has been said in this that the recovery from the consumers by fixing the price of electricity every month Order of March, Section- of the Electricity Act : 4 is against, so the said arbitrary order should be deleted.
Actually, under the provision, electricity rates can be determined only once a year, but the Electricity Regulatory Commission amended it to add energy cost along with fuel cost. Also issued orders to fix and recover fuel charges on monthly basis. Despite the fact that for determination of electricity tariff this year 414 December, 750 There is a provision in the public notice to fix the rates on the basis of energy cost only. On the basis of this, a public hearing was also organized in January, . In view of all this, the amendment and the order issued accordingly to fix the price of electricity on monthly basis is illegal.
