The court has said that if an employee has been paid more due to the mistake of the administration, then it cannot be recovered after retirement. Omprakash Vyas, a resident of Sudama Nagar, was posted as a grade 3 employee in the collector’s office in the year 2018. Due to the mistake of the government, Vyas was given a higher pay scale at the time of appointment. When Vyas retired in the year 2018, the government deducted two lakh rupees from his graduation and argued that the pay scale was calculated at the time of appointment. was done wrong. Thousands of rupees were also deducted from Vyas’s three salaries. Vyas took objection to this action of the government and filed a petition in the court. At the time of retirement the amount was deducted without informing. After agreeing with the arguments advanced by the petitioner, the court accepted the petition. The court ordered the government to return the amount recovered from the petitioner in day.
