Here the disqualification of Lakshadweep Member of Parliament Mohammad Faizal was seen as a recent example. Faizal was convicted in an attempt to murder case on 11 January, 2023, with immediate and automatic disqualification from the membership of the Lok Sabha by virtue of section 8(3) of the RP Act Disqualification was attracted. Two days after the conviction, the Lok Sabha Secretariat notified Faizal’s disqualification from January 11. The Election Commission immediately announced the by-elections and linked it with the assembly elections in the three northeastern states. However, his sentence was stayed by the Kerala High Court, prompting the Election Commission to suspend the election notification. Interestingly, the Kerala High Court’s relief effectively restored his membership of the Lok Sabha, but Faizal cannot participate in the proceedings of the House even today.
