Expansion The Madhya Pradesh High Court in Jabalpur has sentenced an accused to life imprisonment for the crime of murder. The police had registered a case against the accused person under other sections including dowry death. But during the trial, the court found that the pregnant deceased’s feet were fixed on the wooden table.
Case registered for dowry death
According to the prosecution, Sonu alias Rahul Thakur, who was living on rent at his maternal uncle’s house in Samta Colony under Gohalpur Police Station 2013 on January 2013 had a love marriage with Priya Thakur. The husband used to torture her mentally and physically while demanding one lakh rupees in dowry. For this reason Priya committed suicide by hanging herself at home on 6th February . Police registered a case against the accused youth under sections 2013B, 2013 and Dowry Act in the court. Invoice was presented.
During the course of hearing, the Court was informed that between the accused and his wife 24 on January 2014 was voluntarily divorced. In the stamp paper, both of them got divorced in front of the notary. After the divorce, the woman had gone to her maternal home. On the day of the incident, the accused had gone to a marriage function. During this, the woman came to his house and committed suicide by hanging herself in the room.
Prosecution could not prove the allegation of harassment for dowry
The prosecution could not prove that the accused youth used to torture the woman for dowry. The court found during the trial that the circumstantial evidence pointed to the commission of the offense of murder. The court found during the hearing that the statement of the accused that when he returned from the marriage, the maternal uncle informed him that Priya had committed suicide by hanging herself. The uncle of the landlord says that after returning from the marriage, the accused went to his room and saw Priya hanging on the noose.
The court found during the hearing that the accused youth could not tell whose marriage and where he had gone. According to the postmortem report, the woman had a four-month-old fetus in her womb. The signatures of the witnesses present at the time of taking the divorce were not obtained. The signature of the notarized advocate was also not obtained to prove that Priya’s signature was on the stamp paper.
The court sentenced on the basis of circumstantial evidence
On the basis of circumstantial evidence, the feet of the deceased were fixed on the wooden table. When the feet were on the table then how can she hang herself. There were injury marks on the woman’s body. On the basis of circumstantial evidence, the court convicted the accused of murder and sentenced him to life imprisonment and a fine of Rs. ,
